Can You Convert a Tourist Visa to a Work Visa Abroad?

You are in the US, the UK, Canada or Australia on a tourist visa, an opportunity or a job offer comes up, and the obvious question follows: can you switch straight to a work visa without flying home first?

For almost every major destination Indians travel to, the answer is no. A tourist or visitor visa is issued on the basis that you will not work, and immigration authorities in these countries generally will not let you convert it into a work visa while you remain there. The standard route is to return to India, apply for the correct work visa from here, and travel back once it is issued.

Why the conversion is not allowed

A tourist visa is granted on a declared purpose — sightseeing, visiting family, attending an event — and on the understanding that you intend to return home once that purpose is served. Taking up paid work on that visa is a breach of its conditions in every country we handle applications for, not a grey area. Working on a tourist visa, or trying to switch status locally to avoid an outbound flight, risks:

  • Your current visa being cancelled on the spot
  • Deportation and a re-entry ban, sometimes for several years
  • The job offer itself being invalidated, since most employers require a valid work authorisation before they can legally employ you

What this looks like by destination

The general rule is the same everywhere, though the mechanics differ slightly. We confirm the current position for your specific case at the assessment — immigration rules do get revised.

  • United States. A B1/B2 visitor cannot switch to H1B, L1 or any employment status while inside the US in the ordinary case. The employer sponsors the work visa, and you attend the interview at a US consulate — typically from India.

  • United Kingdom. The Standard Visitor route explicitly bars switching to the Skilled Worker route from inside the UK. You return to India and apply for the Skilled Worker visa against a genuine Certificate of Sponsorship.

  • Canada. A visitor cannot generally apply for a work permit from inside Canada without first leaving, except in a narrow set of exempted situations. The standard path is a fresh work permit application from India, LMIA-backed unless the role is exempt.

  • Australia. Skills in Demand (482) sponsorship is arranged by the employer and lodged as a fresh application; it is not a status change you can make while visiting on a tourist visa.

What to actually do if this happens to you

  1. Get the offer in writing. A genuine written offer from a real employer is the starting point for every one of these routes — nothing moves without it.

  2. Check the visa route matches the offer. Business visitor, skilled worker and intra-company transfer routes all have different eligibility rules; picking the wrong one is a common, avoidable delay.

  3. Return to India before the tourist visa expires. Overstaying while a work visa application is pending anywhere is treated as a serious violation, not a technicality.

  4. Apply for the correct work visa from India. This is where the employer’s sponsorship, your documents and (for the US) the consular interview come in.
